Shikideals Advertiser and Listing Terms for Advertisers (Businesses)

Effective date: 12 September 2026

Website: www.shikideals.com.au

Operator: MULTISEEK (ABN 14 977 556 780), trading as Shikideals, Sydney, New South Wales, Australia

These Advertiser and Listing Terms govern business accounts, advertisements, offers, promotions and other content submitted for publication on Shikideals. They supplement our general Website Terms and Conditions and Privacy Policy. If there is an inconsistency about an advertiser account or listing, these Advertiser and Listing Terms apply to that extent.

By creating an advertiser account, submitting a listing, purchasing an advertising package or accepting these terms electronically, you agree to these terms. If you act for a business, you confirm that you are authorised to bind it. The English version prevails to the extent permitted by law; translations are for convenience only.

1 Definitions

Advertiser means a merchant, supplier, vendor, affiliate advertiser or other business that submits a Listing. Listing means an advertisement, product, service, offer, deal, coupon, promotion, profile, image, link or other content submitted for display. Customer means a Website user who views a Listing, makes an enquiry or proceeds to an Advertiser or third-party booking platform. Website means shikideals.com.au and services controlled by us.

2 Eligibility and accounts

To hold an Advertiser account, you must:

  • be at least 18 years old and have legal capacity and authority to enter this agreement;
  • provide complete, current and accurate identity, business, contact and payment information;
  • maintain all registrations, licences, permits, qualifications and insurance required for your business and Listings;
  • keep login credentials secure and restrict account access to authorised representatives; and
  • notify us promptly at info@shikideals.com.au if you suspect unauthorised access or inaccurate account information.

You are responsible for activity undertaken through your account, except to the extent caused by our failure to take reasonable security precautions. If third-party sign-in is available, the third party’s terms also apply.

3 Our platform role

Shikideals provides marketing, advertising, referral and listing services. We may receive advertising fees, affiliate commissions or referral payments. Unless a page expressly states otherwise, we are not the merchant of record, do not contract with the Customer for the advertised product or service, do not collect or hold the Customer’s payment, and do not supply the advertised product or service.

The Advertiser or identified third-party merchant is responsible for accepting or rejecting a booking, taking payment, issuing confirmation, supplying the product, customer support, cancellations, refunds and compliance with its contract and applicable law. Nothing in these terms excludes responsibility that Shikideals cannot lawfully exclude for its own services, representations or conduct.

4 Advertiser warranties and responsibilities

You warrant on submission and throughout publication that:

  • your identity, business details, licences, permits, insurance and contact details are accurate and current;
  • you are legally entitled and operationally able to offer and supply every advertised product or service;
  • each Listing is accurate, current, complete, lawful and not false, misleading or deceptive;
  • you hold all rights, permissions and releases required for text, images, trade marks, reviews and other content;
  • prices, mandatory charges, taxes, availability, inclusions, exclusions, restrictions and material conditions are prominently and accurately disclosed;
  • you will honour valid advertised offers, confirmations and consumer rights, subject to disclosed terms and applicable law;
  • you will promptly correct or ask us to remove information that becomes inaccurate or unavailable; and
  • you will comply with laws applying to your business, the Customer, the destination and the advertised service.

5 Listing standards

Listings must:

  • be in clear English, with any translation being accurate;
  • appear in the appropriate category and describe the actual product or service offered;
  • identify the responsible supplier or merchant and clearly disclose commercial, affiliate or sponsorship relationships where required;
  • state the total price as required by applicable law, including mandatory fees and GST where applicable, and clearly identify optional charges;
  • state important booking, eligibility, safety, cancellation, refund, minimum-participant and expiry conditions;
  • avoid discriminatory, abusive, defamatory, obscene or exploitative content;
  • avoid duplicate postings, keyword stuffing, hidden text, deceptive redirects or other search manipulation; and
  • comply with our reasonable technical specifications and content instructions notified before submission.

6 Prohibited listings and conduct

You must not submit or use the Website for:

  • illegal, stolen, counterfeit, unsafe or unlawfully supplied goods or services;
  • weapons, illegal drugs, tobacco or vaping products, gambling services, securities, cryptocurrency promotions, pornography, escort services or unlawfully marketed therapeutic goods;
  • content that infringes intellectual property, privacy, publicity or other rights;
  • offers that exploit disasters, emergencies, vulnerable persons or children;
  • spam, pyramid schemes, deceptive reviews, impersonation or collection of personal information without authority;
  • malware, destructive code, credential theft, unauthorised access or interference with security;
  • scraping or automated access contrary to published instructions or that imposes an unreasonable load; or
  • any attempt to bypass account restrictions, moderation, fees or access controls.

This list is not exhaustive. We may reject other Listings where publication would be unlawful or create a material safety, fraud, security or reputational risk.

7 Advertising fees GST and payment

The applicable package, publication period, price and inclusions will be shown before purchase or recorded in a separate written order. Unless stated otherwise, prices charged by us are in Australian dollars and include GST where GST applies. You authorise our payment provider to process the agreed advertising charges.

An advertising fee is not refundable merely because a Listing receives no enquiries, clicks or sales. If we do not provide a paid advertising service, remove a compliant Listing without a permitted reason, or if a refund or other remedy is required by law, we will provide the remedy required in the circumstances. Any approved refund will ordinarily be returned to the original payment method.

If a package renews automatically, the renewal interval, price and cancellation method will be disclosed before purchase. You may cancel future renewals using the stated method or by contacting us before the next renewal date. Cancellation ordinarily takes effect at the end of the current paid period. We will not impose a cancellation fee unless it was clearly disclosed and is permitted by law.

8 Listing locations categories and service areas

We may reasonably add, combine, divide or rename listing categories, service areas, regions or local-government areas to reflect Website demand and operation. We will not materially reduce the remaining benefit of a current paid package without reasonable notice and an appropriate alternative, adjustment or remedy where required by the package terms or law.

9 Customer transactions taxes and support

You contract directly with the Customer or through the merchant or booking platform identified to the Customer. You are responsible for payment collection, receipts, taxes, confirmations, fulfilment, support, changes, cancellations, refunds, chargebacks and complaints arising from that transaction. You must not represent that Shikideals supplies or guarantees your product unless we have expressly agreed in writing.

10 Enquiries referrals and personal information

Where we provide Customer enquiry or referral information, you may use it only to respond to that enquiry, administer the resulting relationship and comply with law. You must protect it, restrict access, comply with privacy and marketing laws, and not sell it or use it for unrelated marketing without a lawful basis. Our collection and handling are described in the Shikideals Privacy Policy.

11 Review moderation and notices

We may review, request evidence about, edit for formatting, decline, suspend or remove a Listing where reasonably necessary to enforce these terms, address a complaint, correct an apparent error, protect users or security, comply with law or manage the Website. Review or publication does not mean we verify, approve or endorse a Listing.

Except where urgent action is reasonably required for safety, fraud, security or legal compliance, we will use reasonable efforts to explain a material rejection, suspension or removal and allow a reasonable opportunity to respond or correct the issue. We may preserve relevant records and report suspected unlawful activity where authorised or required by law.

12 Advertiser content licence

You retain ownership of your content. You grant us a non-exclusive, worldwide, royalty-free licence during the Listing period and for a reasonable archival period to host, reproduce, resize, format, translate, display, distribute and promote the content for operating, marketing and recording the Website and Listing. The licence includes use through our controlled social-media channels and technical service providers. We will not materially alter the meaning of a Listing without permission.

Shikideals’ original branding, Website design, software and content are owned by or licensed to us. No right to use our name, logo or materials is granted except as expressly authorised in writing.

13 Third party services

The Website may use third-party hosting, authentication, payment, analytics, booking, communications or social-media services. Their separate terms and privacy policies may apply. We are not responsible for an independent third party’s acts, omissions or availability, except to the extent responsibility cannot lawfully be excluded or the issue was caused by our conduct.

14 Suspension and termination

We may suspend or terminate an account or Listing where reasonably necessary because:

  • fees are overdue after any applicable notice or cure period;
  • information is materially inaccurate, misleading, unlawful, infringing or unsafe;
  • you materially or repeatedly breach these terms or another applicable Website policy;
  • we reasonably suspect fraud, misuse, unauthorised access or a material security risk;
  • a regulator, court, law-enforcement agency or rights holder makes a valid request;
  • continued publication could expose a user or another person to material harm; or
  • the relevant service is discontinued or materially changed.

You may request account closure or non-renewal by contacting us. Termination does not affect accrued rights, payment obligations or provisions intended to survive, including intellectual property, confidentiality, liability and indemnity. Account data will be handled under our Privacy Policy and applicable retention obligations.

15 Service availability and changes

We do not promise uninterrupted or error-free availability. We may maintain, secure, modify or discontinue Website features. For a material change affecting a paid current package, we will give reasonable notice where practicable and provide any adjustment or remedy required by the package terms or law.

16 Australian Consumer Law

Nothing in these terms excludes, restricts or modifies a guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Competition and Consumer Act 2010 (Cth) and its Australian Consumer Law. If you acquire our services as a consumer, any applicable consumer guarantees continue to apply.

17 Liability

Subject to clause 16 and to the maximum extent permitted by law:

  • we are not liable for an Advertiser’s or other third party’s products, services, acts, omissions, content, insolvency or customer contract;
  • we are not liable for loss caused by your inaccurate content, breach of these terms, unlawful conduct or failure to fulfil a Customer transaction; and
  • neither party is liable to the other for indirect or consequential loss that was not reasonably foreseeable, except where liability cannot lawfully be excluded.

These limitations do not apply to the extent loss is caused by a party’s negligence, fraud, wilful misconduct, breach of contract, infringement, misleading or deceptive conduct, or other liability that cannot lawfully be excluded.

18 Indemnity

To the extent permitted by law, you indemnify Shikideals against third-party claims and reasonable direct costs arising from your Listing, advertised product, breach of these terms, infringement of rights, unlawful conduct, failure to fulfil a Customer transaction, or personal injury, death or property damage caused by your product or conduct. This indemnity is reduced to the extent that Shikideals or another person caused or contributed to the claim or loss. We will take reasonable steps to mitigate recoverable loss.

19 Changes to these terms

We may update these terms for operational, security, legal or commercial reasons. Updated terms apply from the effective date displayed and will not retrospectively change an agreed current advertising package unless required by law or agreed with you. We will provide reasonable notice of a material change affecting an account-based service where practicable.

20 Complaints and notices

Send complaints, infringement notices, security reports and other notices to info@shikideals.com.au. Include your name, business, account or Listing details, the issue, supporting information and the outcome sought. We aim to acknowledge complaints within 2 business days and provide a substantive response within 10 business days where reasonably practicable.

21 Governing law and general terms

These terms are governed by the laws of New South Wales and the Commonwealth of Australia. The parties submit to the non-exclusive jurisdiction of courts and tribunals with jurisdiction in New South Wales. This does not prevent a party from exercising a right in another forum where applicable law permits it.

If a provision is invalid or unenforceable, it is read down to the extent necessary or severed, and the remaining provisions continue. A failure or delay in exercising a right is not a waiver. You may not assign this agreement without our written consent, not to be unreasonably withheld. We may assign it as part of a genuine business transfer provided the assignee assumes our obligations.
